Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. Contest entries accepted between 12:01 AM Eastern Time ("ET") on August 13, 2007 and 11:59 PM (ET) on October 15, 2007 ("Contest Entry Period").

Eligibility: The Find Your Strength Contest ("Contest") is open to legal residents of the 50 United States and District of Columbia age 21 or older at time of entry. Employees of Real Simple Magazine (the "Sponsor"), L'Oreal USA Inc. ("L'Oreal") and their parent, subsidiaries, affiliates, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible to enter or win. Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.

How to enter: Visit www.findstrength.com and follow all entry instructions to complete and submit the entry form, including typing in the required field an essay of 300 words or less describing how you find your personal strength each day. Your essay must be original, written solely in English and by you. Essays must not defame or violate the privacy or publicity rights of any other person or entity, and essays must not violate any third-party rights. All entries must be received during the Contest Entry Period. Limit one entry per person. Contestants who attempt to enter with multiple e-mail addresses or under multiple identities will be disqualified. All entries submitted become the property of Sponsor and L'Oreal and will not be returned or acknowledged.

Conditions: Submission of an essay grants Sponsor and L'Oreal the exclusive royalty free world wide right to print, copy, publish, use, edit, exhibit, distribute, merchandize, license, sublicense, adapt and/or modify such essay in any way (and to publish the Contestant's name along with such essay), in any and all media whether now known or hereafter developed, without limitation and without compensation to the Contestant. Submission of an essay further constitutes the Contestant's consent to irrevocably assign and transfer to Sponsor and L'Oreal any and all rights, title and interest in the essay, including, without limitation, all copyrights and any ideas encompassed therein. Contestant agrees to sign any documents deemed necessary to accomplish the transfer of rights. In addition, the Contestant must certify that the essay was original and written by the Contestant, that the essay has not been submitted in any other contest, and that no other person or entity holds rights to the essay. Failure to provide such certification will result in disqualification and the Contestant with the next highest score will be declared the winner.

Contestants will indemnify, defend and hold harmless the Sponsor and L'Oreal, at its own expense against any claims, actions, damages and costs (including but not being limited to reasonable attorneys' fees and costs) whether or not foreseeable, arising out of any third party claim alleging (a) any infringement of copyrights or other Intellectual Property Rights of third parties against to the extent such claim, demand, suit or action alleges that the entry submitted infringe any Intellectual Property Right of any third party, (b) Contestant's breach of any covenant, representation or warranty made by Contestant hereunder; and (c) the entry submitted contains any illegal material or violates any law or any person's right of publicity, privacy or personality.

Judging: There will be two rounds of judging. All entries will be judged based on the following equally weighted judging criteria:

Round One: A panel of judges, consisting of personnel from Real Simple Magazine, will judge all entries to determine the top scoring 20 entries. These top 20 entries will advance to round two.

Round Two: A panel of judges, consisting of personnel from L'Oreal, will judge the top scoring 20 entries. The highest scoring entry will be declared the winner of the Contest.

Ties: In the event of a tie at any stage in judging process, ties will be broken based on the highest score for your writing skills. In case of a further tie, such tie will be broken based on the highest score for how compelling your story is. Judges' decisions are final.

Winner Notification: Sponsor or its designated agent will attempt to notify winner by telephone, mail and/or email on or about November 12, 2007, and winner will be required to complete and return an Affidavit of Eligibility, a copyright release, and a Liability and Publicity Release ("Affidavit/Release") which must be signed, notarized and received by Sponsor or its designated agent within 14 days of date printed on notification or an alternate winner will be determined. If this is the case, the Contestant with the next highest overall score will be declared the alternate winner. At the Sponsor's discretion, a telephone interview/background check may be conducted on winner. If winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who may be required to execute Affidavit on minor's behalf.

Grand Prize/Approximate Retail Value ("ARV"): One winner will receive one (1) monthly session with a personal trainer for one (1) year, total 12 sessions (ARV: $1,200.00), a one day pass to a luxurious spa (ARV: $500.00) and a Skin Genesis multi-layer Cell Strengthening Skincare package (ARV: $75.00). Selection of personal trainer, spa and skincare package is at the Sponsor's sole discretion. Services provided by the personal trainer are subject to his/her terms and conditions. If personal trainer services and/or day pass to spa are not available, at the Sponsor's sole discretion, a prize of equal or greater value will be awarded. Once the Sponsor arranges the sessions with the personal trainer and day pass to spa, the Sponsor will not be held responsible for any cancellation or postponement thereafter and the Sponsor shall have no further obligation to the winner. If winner chooses not to utilize the services of the personal trainer and/or day pass to spa, said portion of the prize will be forfeited without further compensation and will not be awarded. Total ARV for Grand Prize: $1,775.00. Winner is responsible for all federal, state, local sales and income taxes. Any other incidental expenses on prize not specified herein are the sole responsibility of winner. No substitutions are permitted except by the Sponsor who reserves the right to award a prize of equal value if prize is unavailable as determined by Sponsor in its sole discretion. Prize is not redeemable for cash. Prize is non-assignable and non-transferable except to a surviving spouse.

General Provisions & Limitations: Acceptance of prize constitutes permission (except where prohibited by law) to use winner's name, hometown and likeness for purposes of advertising, promotion and publicity without additional compensation. Participating Contestants agree to these Official Rules and the decisions of the judges and hold harmless the Sponsor and L'Oreal, and release the Sponsor and L'Oreal, and their affiliated companies, and all other businesses involved in this Contest, as well as the employees, officers, directors, shareholders and agents of each, from all claims and liability relating to their participation and acceptance of prize. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Contest or use or redemption of the prize. Sponsor and L'Oreal are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize.

Arbitration: By participating in this Contest, Contestants agree that New York courts shall have jurisdiction over any dispute or litigation arising from or relating to this Contest and that venue shall be only in New York, NY. Interpretation of the terms and conditions of this Contest shall be governed by New York law.

Notice to Contestants: In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor is not responsible for problems uploading or downloading any Contest-related information from the web site or for any other technical malfunctions of electronic equipment, computer on-line systems, servers, or providers, computer hardware or software failures, phone lines, failure of any electronic mail entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the web site, or any other technical problems related to web site entries including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Contestant's ability to participate in this Contest. If applicable, mass entries or entries generated by a script, macro or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes beyond Sponsor's control which corrupt the administration, security, fairness, integrity or proper play of the Contest. If this is the case, winner will be determined from among all eligible entries received prior to cancellation. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of this Contest or web site or to be acting in violation of the Contest Official Rules.

Caution: Any attempt by a Contestant to deliberately damage any web site or undermine the legitimate operations of the Contest is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such Contestant to the fullest extent permitted by law and to disqualify such Contestant from the Contest.
